Terms & Conditions

These Terms & Conditions ("Terms") form a binding agreement between you and EQ-Ride Transport Co. ("EQ-Ride", "we", "us"). By registering an account, browsing loads or routes, posting a request, accepting a haul, or otherwise using the EQ-Ride website, mobile experiences, or related services (collectively, the "Platform"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

You must be at least 18 years old and able to form a legally binding contract. Transporters ("Drivers") must additionally hold all federal, state, and local authority required to transport live animals for compensation, including a valid USDOT/MC number where applicable, current commercial liability and cargo insurance, and any state-mandated health-papers or interstate permits. Horse owners ("Owners") represent that they have legal authority to ship the animals listed in any request.

EQ-Ride is a technology platform that connects independent Owners with independent Drivers. We are not a motor carrier, freight broker of record for any individual haul, veterinarian, insurer, or party to the transport contract formed between Owner and Driver. EQ-Ride does not own, operate, or control any trailer or animal listed on the Platform.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to keep it up to date. EQ-Ride may verify identity, insurance, authority, and payment information at any time and may suspend or terminate accounts that fail verification or that we reasonably believe present a safety, legal, or fraud risk.

Owners pay quoted haul fees to EQ-Ride through the Platform's secure payment system. EQ-Ride is the merchant of record for transportation services and pays the Driver as an independent contractor after the Owner confirms delivery. EQ-Ride charges a platform fee (currently 5%, reduced to 2.5% for active Platinum Drivers) deducted from the gross haul amount, plus any applicable membership or subscription fees. All amounts are in U.S. dollars and are non-refundable except as expressly stated or required by law. Chargebacks initiated without first attempting resolution through EQ-Ride support may result in account suspension.

Cancellation windows, no-show fees, and rescheduling policies are presented at the time of booking and form part of these Terms. Disputes about delivery condition, timing, or charges must be opened through the in-app dispute tool within 72 hours of scheduled delivery. EQ-Ride may, at its sole discretion, mediate, delay driver payouts, issue partial refunds, or reverse driver payouts while a dispute is investigated. EQ-Ride's resolution decision is final for purposes of Platform-handled funds; either party retains any rights they have outside the Platform.

Drivers agree to transport horses in a safe, humane, and lawful manner, with appropriate rest, water, ventilation, and footing, and to comply with the federal Commercial Transportation of Equines for Slaughter regulations and all applicable hours-of-service rules. Drivers will provide timely transit updates and proof-of-pickup / proof-of-delivery photos through the Platform. Owners agree to present horses fit to travel with required negative Coggins, health certificates, and any state-entry documentation. Either party may flag conduct concerns; EQ-Ride may remove users for confirmed welfare violations.

Drivers must maintain commercial auto liability of no less than $1,000,000 combined single limit and live-animal cargo coverage appropriate to the value of the horses transported. Risk of loss during transport rests with the Driver from the time of pickup until the Owner confirms delivery, subject to the Driver's policy terms and any signed bill of lading. EQ-Ride does not provide insurance and is not liable for loss, injury, illness, or death of any animal in transit.

You agree not to:

• circumvent the Platform to avoid fees on hauls introduced through EQ-Ride for 12 months after introduction;
• misrepresent identity, insurance, authority, animal condition, or pickup/delivery details;
• use the Platform to transport animals other than equines without prior written permission;
• scrape, reverse engineer, or interfere with the Platform's operation or security;
• harass, threaten, or discriminate against other users or EQ-Ride staff.

You retain ownership of photos, reviews, route details, and other content you submit. You grant EQ-Ride a worldwide, royalty-free, non-exclusive license to host, display, reproduce, and adapt that content for the purpose of operating, marketing, and improving the Platform. You represent that you have the rights necessary to grant this license.

Owner Memberships and Driver Platinum subscriptions renew automatically at the interval selected until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and previously paid amounts are not refunded except where required by law.

You may close your account at any time. EQ-Ride may suspend or terminate access immediately for breach of these Terms, fraud, safety concerns, or as required by law. Sections that by their nature should survive termination — including payment obligations, dispute outcomes, indemnity, limitation of liability, and dispute resolution — will survive.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. EQ-RIDE DOES NOT WARRANT THE CONDUCT OF ANY OWNER OR DRIVER, THE ACCURACY OF LISTINGS, OR THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW, EQ-RIDE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE PLATFORM FEES YOU PAID EQ-RIDE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) U.S. $100. EQ-RIDE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR ANIMALS, EVEN IF ADVISED OF THE POSSIBILITY.

You agree to indemnify and hold harmless EQ-Ride, its affiliates, and their officers, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Platform, your content, your breach of these Terms, or your violation of any law or third-party right — including any claim by an Owner or Driver arising from a haul you booked, accepted, or performed.

These Terms are governed by the laws of the State of Kentucky, without regard to conflict-of-law rules. Any dispute not resolved through EQ-Ride's internal process will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Lexington, Kentucky. You and EQ-Ride waive the right to a jury trial and to participate in any class or representative action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing admin@eqride.com.

We may update these Terms from time to time. Material changes will be announced through the Platform or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the revised Terms.
